PUBLICATION OF THE GOVERNMENT ASSISTANCE AND SUBSIDIES PROGRAM BENEFICIARIES ON THE DEPARTMENT OF EDUCATION'S OFFICIAL WEBSITE

1. The Department of Education (DepEd) announces the publication of the list of learners participating in the Government Assistance and Subsidies (GAS) programs particularly in Educational Service Contracting (ESC), Senior High School Voucher Program (SHS VP), and Joint Delivery Voucher Program for Technical, Vocational, and Livelihood (JDVP-TVL) on the Department's official website.

 

2. The publication of the list of learners participating in the GAS programs complies with Section 28, Article II of the 1987 Constitution, which mandates that the State adopts and implements a policy of full public disclosure for all its transactions involving public interest. This is also in accordance with Republic Act No. 10173, known as the Data Privacy Act of 2012, aimed at protecting personal data in information and communications systems both in the government and private sectors. It safeguards the fundamental human right to privacy while ensuring the free flow of information to promote innovation and growth. 

 

3. The Senate Committee on Basic Education recommended the same during one of its hearings to promote transparency in government and uphold people's fundamental right to information. 

 

4. The publication shall only be limited to the full names of program beneficiaries, consisting of Last Name, First Name, and Middle Initial. 

 

5. The Department shall ensure that the publication of personal data has a corresponding privacy notice to properly inform the beneficiaries of the rationale for such disclosure of personal data, their rights as data subjects, and the contact details of the Department's data protection officer, among other information.

 

6. Prior to the publication of the list, the GAS program beneficiaries are requested to submit the accomplished Data Privacy Notice to the school where they are enrolled. The GAS program-participating schools shall collect and secure the Data Privacy Notice from the program beneficiaries.

 

7. For ESC and SHS VP, the form can be downloaded from the Information Management System (IMS) and Voucher Management System (VMS), respectively. For JDVP, the School Adviser is responsible for distributing the Data Privacy Notice to the JDVP learner-beneficiaries. 

 

8. The template of the Data Privacy Notice is enclosed for reference.
