AMENDMENT TO DEPED ORDER NO. 88, S. 2010, AS AMENDED BY DEPED ORDER NO. 11, S. 2011 AND DEPED ORDER NO. 041, S. 2022

(2010 Revised Manual of Regulations for Private Schools in Basic Education)

1. The Department of Education (DepEd) issued DepEd Order (DO) No. 88, s. 2010, titled 2010 Revised Manual of Regulations for Private Schools in Basic Education, and it was amended through DO 11, s. 2011. Likewise, Sections 160 and 189 of DO 88, s. 2010 on school site requirement, e.g., ownership, and sanctions against private schools were amended by DO 041, s. 2022 titled Amendment to DepEd Order No. 88, s. 2010.

 

2. In the exigency of service and to avoid undue displacement of learners, private schools falling under any one of the following criteria shall be granted a period of two years, e.g., from School Year (SY) 2023-2024 until SY 2024-2025, to comply with the requirements for the issuance of permit to operate:

 

a. those with pending application for renewal,

b. those whose application for government recognition were denied but considered for permit renewal,

c. those with new application submitted within the prescribed period, or

d. those with application considered as new based on justifiable reasons or circumstances such as the lack of a permit in the previous SY.

 

This transitory period shall not apply to the mandatory requirements from the Securities and Exchange Commission and the occupancy permit issued by the concerned local government units.

 

3. All other provisions stated in the 2011 Revised Manual of Regulations for Private Schools in Basic Education shall remain effective, unless otherwise amended by other DepEd issuances.

 

4. Any part of provision of this DO which may be held invalid or declared unconstitutional shall not affect the effectivity and efficiency of operation and implementation of the remaining parts or provisions hereof.

 

5. This Order shall take effect immediately upon its approval, posting on the DepEd website, and publication to the Official Gazette or a newspaper of general circulation and shall be registered with the Office of the National Administrative Register (ONAR) at the University of the Philippines Law Center (UP LC), UP Diliman, Quezon City.
