ISSUANCE OF GOVERNMENT PERMIT AND PROVISIONAL GOVERNMENT PERMIT TO OPERATE TO PHILIPPINE SCHOOLS OVERSEAS FOR SCHOOL YEARS 2019-2020, 2020-2021, 2021-2022, 2022-2023 AND 2023-2024 IN CONSIDERATION OF COVID-19 PANDEMIC

1. The Department of Education (DepEd), pursuant to DepEd Order (DO) No. 039, s. 2020 titled Special Provision on Private School Voluntary Closures and Participation in Government Assistance and Subsidies Programs in Light of the COVID-19 Pandemic (Amends Certain Provisions of DepEd Order No. 88, s. 2010), upholds the right of every Filipino to quality basic education by providing access through public or private educational institutions. 

 

2. Furthermore, Section 8 of the Manual of Policies, Standards and Regulations (MPSR) provides that the administration of the educational system and the general supervision and regulation of all educational institutions in basic education is vested in DepEd, without prejudice to the host country and the education counterpart of the Department. 

 

3. In the exigency of the service and to avoid undue displacement of learners, Philippine Schools _Overseas (PSO) falling under any one of the following criteria shall be/granted a period of one year from the publication date of this Memorandum to comply with the requirements for the issuance of permit to operate:

 

a. those with pending applications for renewal for School Years (SY) 2019- 2020, 2020-2021, 2021-2022, 2022-2023, and 2023-2024; 

b. those whose applications for government recognition were denied but considered for permit renewal; 

c. those with new applications submitted within the prescribed period; 

d. or those with applications considered as new based on justifiable reasons or circumstances such as the lack of permit in the previous SY. 

 

This transitory period shall not apply to the mandatory requirements implemented by the host country where the PSO is located. 

 

4. Pursuant to Section 24 of the MPSR, all PSOs for SY 2024-2025 and onwards shall submit to DepEd their application for permit to operate at least six months before the start of the proposed SY of operation. Accordingly, it shall specify the program the applicant school will implement. 

 

5. All other provisions stated in the MPSR shall remain effective, unless otherwise amended by other DepEd issuances. 

 

6. Any provision of this Memorandum declared to be invalid or unconstitutional shall not affect the effectivity and efficiency of the operation and implementation of other parts or provisions hereof.
