Reiteration of the “No Collection Policy” in Schools

 

DepEd Memorandum No. 041, s. 2024, reiterates the "No Collection Policy" in schools, aligning with Republic Act No. 4206 and DepEd Order No. 19, s. 2008. It prohibits the collection of fees from learners, except in specified cases, and underscores penalties for non-compliance. REITERATION OF THE “NO COLLECTION POLICY” IN SCHOOLS

All Others Concerned

 

1. Following Republic Act No. (RA) 4206, also known as “An Act Prohibiting the Sale of Tickets and/or the Collection of Contributions for Whatever Project or Purpose from Students and Teachers of Public and Private Schools, Colleges and Universities,” as amended by RA 5546, the Department of Education (DepEd) issued DepEd Order (DO) No. 19, s. 2008, titled “Implementation of No Collection Policy in All Public Elementary and Secondary Schools,” prohibiting the collection of fees from learners during the enrolment period and at any time during the school year.

 

2. Pursuant to Section 1, RA 4206, as amended by RA 5546, it is hereby reiterated that “the sale of tickets and/ or the collection of contributions in any form whatsoever, by any person for any project or purpose, whether voluntaryor otherwise, from school children, students and teachers of public and private schools, colleges and universities is hereby prohibitedProvidedhowever, that this prohibition shall not cover membership fees of school children and students the Red Cross, the Girl Scouts of the Philippines and the Boy Scouts of the Philippines: Provided, finally, that this Prohibition shall not cover the contributions of parents and other donors for the support of barrio high schools.”

 

3. Section 2, RA 4206, as amended, provides that non-compliance with the aforementioned prohibition shall be penalized with a fine or imprisonment for not more than one month, or both, in the discretion of the court.

 

4. All DepEd personnel are advised of DO No. 49, s. 2022, titled Amendments to DepEd Order No. 04 7, s. 2022 (Promotion of Professionalism in the Implementation and Delivery of Basic Education and Programs and Services). This directive serves as reminder to DepEd personnel to refrain from unwarranted solicitations and collection of contributions.

 

5. This Order hereby underscores the policy that sales of tickets and/or all forms of contributions, voluntary or otherwise, are prohibited except for the instances provided under RA 4206, as amended.

 

6. All previous issuances which are inconsistent with the provisions of this Order are hereby repealed or modified accordingly.

 

7. All Regional and Schools Division Offices are instructed to establish their respective monitoring mechanisms and ensure the continuing compliance of schools with aforementioned Department issuances.

 

8. Immediate dissemination of and strict compliance with this Memorandum is directed.
