CREATION OF THE PREQUALIFICATION/QUALIFICATION, BIDS AND AWARDS COMMITTEE FOR THE PUBLIC-PRIVATE PARTNERSHIP FOR SCHOOL INFRASTRUCTURE PROJECT-ID

1. The Department of Education (DepEd) is implementing the Public-Private Partnership for School Infrastructure Project Phase III (PSIP III) in line with its commitment to address the country's long-standing classroom shortage and improve learning conditions in public schools. PSIP III is designed to supplement DepEd's existing basic education facilities program to leverage private sector efficiency through a solicited public-private partnership (PPP) modality and a Build-Lease-and-Transfer (BLT) contractual arrangement.
2. This Order establishes the Prequalification/Qualification, Bids, and Awards Committee (PBAC) for PSIP III to ensure efficient, transparent, and timely conduct of the procurement process.
3. In the exigency and best interest of the service, and in compliance with Republic Act No.11966, otherwise known as the Public-Private Partnership Code of the Philippines, and its Implementing Rules and Regulations (IRR), the PBAC that will undertake the procurement is hereby constituted, as provided in the Enclosure.
4. Pursuant to Section 61 of the PPP Code IRR, the PBAC created shall be responsible for all aspects of the pre-bidding and bidding processes, including, among others:
a. preparation and issuance of the tender documents;
b. publication of the Invitation to Qualify /Pre-qualify and Bid / for Comparative Proposals;
c. assessment of qualification/pre-qualification of prospective bidders/ challengers;
d. conduct of pre-bid conferences and issuance of bid bulletins and supplemental notices;
e. interpretation of the rules regarding the bidding;
f. conduct of bidding;
g. evaluation of bids;
h. resolution of protests in accordance with Sections 82 and 83 of the PPP Code IRR; and
i. recommendation for the acceptance of the bid and/or for the award of the PPP Contract.
5. In the exercise of its functions, the PBAC may create a Technical Working Group (TWG) to assist and aid in the performance of the above-mentioned functions. The TWG shall be composed of technical staff with the same required expertise as the members of the PBAC.
6. This Order shall take effect immediately upon its approval, issuance, and publication on the DepEd website. Certified copies of this Order shall be registered with the Office of the National Administrative Register (ONAR) at the University of the Philippines Law Center (UP LC), UP Diliman, Quezon City.
