DISSEMINATION OF IMPLEMENTING RULES AND REGULATIONS OF THE REPUBLIC ACT NO. 11480, TITLED AN ACT AMENDING SECTION 3 OF REPUBLIC ACT NO. 7797, OTHERWISE KNOWN AS AN ACT TO LENGTHEN THE SCHOOL CALENDAR FROM TWO HUNDRED DAYS TO NOT MORE THAN TWO HUNDRED TWENTY CLASS DAYS

1. For the information and guidance of all concerned, enclosed is a copy of the Implementing Rules and Regulations (IRR) of the Republic Act (RA) No. 11480, titled An Act Amending Section 3 of Republic Act No. 7797, otherwise known as An Act to Lengthen the School Calendar from Two Hundred (200) Days to Not More Than Two Hundred Twenty (220) Class Days.

 

2. In accordance with Section 12[This IRR shall take effect immediately after its publication in the Official Gazette] of the IRR, these rules and regulations shall take effect immediately after its publication in the Official Gazette (OG). The IRR was published in the OG, Volume 120, No. 47, and thus took effect on November 18, 2024.

 

3. All regional offices, schools division offices, and public and private schools are directed to implement the provisions of RA 7797, its IRR, and all relevant and subsequent issuances pursuant to the foregoing.

IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 7797, OTHERWISE KNOWN AS "AN ACT TO LENGTHEN THE SCHOOL CALENDAR FROM TWO HUNDRED (200) DAYS TO NOT MORE THAN TWO HUNDRED TWENTY (220) CLASS DAYS, AS AMENDED BY REPUBLIC ACT NO. 11480

 

Pursuant to Section 4 of REPUBLIC ACT NO. (RA) 7797, titled AN ACT TO LENGTHEN THE SCHOOL CALENDAR FROM TWO HUNDRED (200) DAYS TO NOT MORE THAN TWO HUNDRED TWENTY (220) CLASS DAYS and Section 2, RA No. 11480, titled AN ACT AMENDING SECTION 3 OF REPUBLIC ACT NO. 7797, OTHERWISE KNOWN AS "AN ACT TO LENGTHEN THE SCHOOL CALENDAR FROM TWO HUNDRED (200) DAYS TO NOT MORE THAN TWO HUNDRED TWENTY (220) CLASS DAYS,'' the Secretary of Education, in consultation with relevant stakeholders, hereby issues the following rules and regulations to implement the provisions of the Acts:

 

Section 1. Title - These rules and regulations shall be referred to as the Implementing Rules and Regulations (IRR) of Republic Act No. (RA) 7797 as amended by RA No. 11480.

 

Section 2. Scope and Application - The provisions of this IRR shall apply to all basic education schools falling within the administration and supervision of the Department of Education (DepEd), including foreign or international schools.

 

Section 3. Definition of Terms For purposes of this IRR, the following terms shall mean or be understood as follows:

 

a. Class Days refer to the days when curricular and co-curricular activities are conducted within or outside school premises, including the home, devoted to the attainment of learning objectives and intended to ensure effective delivery of the curriculum.

 

b. Co-curricular activities refer to voluntary and non-graded in- or off-campus activities organized by DepEd to reinforce curriculum delivery. They are considered extension of formal learning experiences as they are anchored on curriculum content and standards and enrich the diverse intelligence and skills of the learners.

 

c. Curricular Activities refer to opportunities and experiences undertaken by the learners in the classrooms, laboratories, workshops, and homes, as well as school-based and out-of-school activities conducted to ensure learners' acquisitions of the K to 12 learning standards and the 21st century skills.

 

d. Foreign or International School refers to educational institution of international character authorized to operate educational programs and services that are comparable, compliant to, on a par with universally acceptable international standards and practices through a legislative franchise.

 

e. School Calendar refers to the required number of class days for the optimum attainment of the learning standards as well as to ensure the observance of national/local school events and activities/celebrations. The school calendar also reflects the events and monthly celebrations/ observances for the year.

 

f. School Year refers to the period of the year during which learners attend an educational institution.

 

g. Secretary refers to the Secretary of DepEd.

 

h. State of Calamity refers to a condition involving mass casualty and/or major damages to property, disruption of means of livelihoods, roads, and normal way of life of people in the affected areas as a result of the occurrence of natural or human-induced hazard, wherein the President declares such condition in the exercise of his/her powers under Section 18, Article VII of the Constitution.

 

i. State of Emergency refers to a condition involving any unforeseen or sudden occurrence, especially danger, demanding immediate action, wherein the President declares such condition in the exercise of his/her powers under Section 18, Article VII of the Constitution.

 

Section 4. Length of School Calendar. The school calendar shall be lengthened to a maximum of two hundred twenty (220) class days, including class days that may be subsequently suspended due to natural or man-made calamities.

 

The increase in the number of class days during the school year shall not be considered as a basis for additional pay for teachers who are paid salaries for the entire twelve (12) months of a school year: Provided, That the preceding provision shall not apply to those who are paid salaries computed by the number of hours they actually teach or whose salaries and hours of work are governed by existing Collective Bargaining Agreements (CBAs).

 

Section 5. Non-reduction of Class Hours -The total number of class hours per day shall not be diminished or reduced to offset any increase in the number of class days. 

 

Section 6. Start of the Regular School Year - DepEd is mandated to formulate and issue an order specifying the start and end of the school year, which may cover either a single school year or a multi-year schedule. Provided, That the school year shall start on the first Monday of June or on a later date not beyond August 31 of the same school year. Provided further, That in the event of a declaration of a state of emergency or state of calamity, the President, upon the recommendation of the Secretary, may set a different date for the start of the school year in the country or any parts thereof

 

Section 7. End of the Regular School Year - The Secretary shall determine the end of the regular school year, taking into consideration the Christmas and summer vacations, and the peculiar circumstances of each region.

 

For purposes of this IRR and consistent with Section 1 of RA No. 7797, the Secretary, in determining the end of the school year shall ensure that the total number of class days does not exceed two hundred twenty (220) class days.

 

Section 8. Conduct of Make-up Classes - The Secretary may authorize the holding of Saturday classes for elementary and secondary levels for public and private schools using appropriate learning delivery modalities.

 

Section 9. Additional Implementing Details/Policies and Guidelines - DepEd may issue such orders enumerating the additional implementing details/policies and guidelines necessary for the effective implementation of the Act and this IRR.

 

Section 10. Separability Clause - If any provision of this IRR is declared unconstitutional, the remainder of this IRR or any provision hereof not affected thereby shall remain in full force and effect.

 

Section 11. Repealing Clause - All provisions of existing implementing rules and regulations, circulars, department issuances, and procedures corresponding to laws and any other law or parts of law inconsistent with this IRR are hereby repealed, amended, or modified accordingly.

 

Section 12. Effectivity- This IRR shall take effect immediately after its publication in the Official Gazette.

 

This IRR shall be registered with the Office of the National Administrative Register, University of the Philippines Law Center, UP Diliman, Quezon City.
